The ex-lawyer for the former president has stepped down as the chief federal prosecutor in the state. This comes after a court battle that challenged her right to occupy the role.

Attorney General's Statement

The nation's top law enforcement official, Pam Bondi, announced the prosecutor's departure on the start of the week. She commented that the appeals court finding made it unworkable for Habba to perform her duties.

"Let no one confuse compliance for surrender," Habba stated. "My fight will now reach across the country."

Legal Background

The departure comes a week after a US appeals court determined that she had been serving in violation of the law as US attorney. This decision is likely to affect numerous legal proceedings in the state.

The appellate judges said that a interim role that did not receive confirmation by the US Senate ran afoul of the statute on vacant positions.

Next Steps and Responses

Bondi said that she will stay on at the Department of Justice as a senior adviser. She will pursue additional appeals of the disqualification, with hopes of a reversal.

In a statement, Bondi wrote that the court "should not be able to second-guess the President's choice of lawyers responsible for performing the primary duty of the administration of prosecuting crime."

Accomplishments Cited

Bondi praised the prosecutor's work and said that during her run, the state capital of Newark saw a one-fifth decrease in criminal activity. Additionally that the city of Camden had its first summer in 50 years without a homicide.

Legal Career

The 41-year-old attorney, was initially recruited to the former president's legal defense in 2021. She later defended her client in his business records case in the previous year, leading to his guilty verdict on dozens of charges of document fraud.

Before Habba took on the federal prosecutor position, the former president had stated he was selecting her as his senior adviser if re-elected, describing the lawyer as "unwavering in her loyalty" and a "tireless advocate for justice".
