US Court Orders Freedom of Abrego Garcia from Immigration Detention

A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks legal authority.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to face human smuggling allegations, he was detained in immigration detention.

In her decision, the court noted that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

Context of the Case

The legal challenge center on disputed claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.

He has also pleaded not guilty to the smuggling counts, which are part of a separate criminal case in Tennessee.

Conditions of Freedom

The court, who was overseeing his challenge to deportation in a federal court, ruled that he must now adhere to the terms of his bond from jail in Tennessee. This decision effectively transfers his monitoring to the jurisdiction handling his criminal case.
